I pay for an 8mb connection. I understand my line can only currently receive 6mb. Which is fine. I don't mind that, that's not Orange's fault.
But.. I'm currently receiving a 0.5mb connection. Whilst paying for an 8mb connection. This is a breach of the Sales of Goods Act, and possibly the Trade Descriptions Act.
They are making me pay full price for a service I am not receiving.
There's no fault with the livebox. There's no fault with the line. It's all Orange.
Everytime I phone up I just get forwarded to someone in India who can't even speak English.
I've e-mailed them 4 times asking for my MAC address so I can migrate - they refuse to give me it.
So I have now stopped paying my bills. I phoned my bank and told them I lost my card (obviously I hadn't), so now I have a new card and Orange can't take any of my payments.
Why pay for a service I'm not receiving? I'm not paying all that money for a 0.5mb connection.
Thursday I received a threatening and harassing letter from Orange. Threatening to take me to court for an outstanding balance of £105.
I contacted them and my words were simply "I DARE you to take me to court. I WANT you to take me to court. Because I already have my statement and argue prepared. By law I do NOT have to pay for a service or goods that I am not receiving. I am paying for a fast broadband connection, and I am NOT receiving it, therefore I am NOT legally obliged to pay. So come on if you have any balls. Take me to court".
It's now 6 days later and I haven't received a court summons or another threatening letter. So I'm assuming they're plotting with their solicitors for a way to get around my argument that I shouldn't have to pay for a service I'm not receiving.
But I am very much looking forward to the court session, if they dare take it that far. I'm logged on now as a 0.5mb connection so they obviously aren't willing to stop being evil.
I told them if I get a court summons I'm going to write to every newspaper available, national and local, and I can already picture the story.
"Full time Carer who saves NHS £500,000 per year victimized, threatened, harassed and bullied by evil Orange corporation refusing to deliver the service he pays for with his £72 p/w Carer's Allowance"
I've complained to OfCom, BBC Watchdog, I've complained to Tonight and Panorama, I've demanded that Orange discusses their evil ways with me via their complaints department but they refuse, again, just forwarding me to someone who can't even speak English.
I've had enough. I'm daring them to take me to court, I'm determined to wage war against these evil bullies. It's unfair that they charge full price for a service that they just don't deliver, and what they're doing is illegal. But because they're a corporation they think they're above the law.
Well. I look forward to their court summons, and I look forward to slaughtering them in civil court, because I guarantee they won't get a penny that I owe them under the argument that they haven't provided the service I was supposed to pay for.
If they win, I plan on committing s-u-i-c-i-d-e in public outside the civil court, already have my note written out, it'll be in my suit pocket at the scene. It will explain I did it in the name of justice and did it for all those poor victims out there who are paying for a service that this evil, evil, corporation ran by the spawn of Satan himself is just not delivering.
I'm sure it won't be necessary for you to take such drastic action.
Remember that there are hundreds of Orange customers who are as frustrated as you and many, many more who have experienced similar frustration.......but, in the end, it's only a broadband connection and there are several ISPs out there who do provide a good service so why not leave Orange and sign up with FAST or Be or o2 (now Sky) or IDNet or ADSL24 or Zen.
If you have proof that you have asked for your MAC code 4 times and not received it then that constitutes breach of contract and also contravenes OFCOM guidelines (General Condition 22).
But remember that the service is UP TO 8mb so 0.5mb is within that parameter even if it is a poor service.
If it goes to court (which I don't believe it will if you keep communicating with Orange) then I wish you success.

0.5 isn't in that parameter. Because there's nothing wrong with my line. They simply aren't providing the service I'm paying for (or, no longer paying for).
And I can't switch, because they refuse to release my line, and they refuse to give me my MAC code.
Nope. I'm going to push them to take me to court, and I will slaughter them there. If not, I will do what's needed to bring it into the eyes of the newspapers and news channels and I will do what is necessary to fight for justice against this evil organization.
I've complained to OfCom. No response. Nothing.
My only choice now is to provoke Orange to take it to the courts where I have my trap already setup for them.
Orange have sent me a letter demanding I pay an outstanding balance.
My argument in court will be.
"Does my greengrocer send me a letter demanding payment for a cabbage that I never bought? No."
I pay for 8mb. I receive 0.5mb. That's non-deliverance of goods. I shouldn't have to pay.
Their argument will be "We say UP to 8mb. You're still receiving A connection."
My argument will go back to the greengrocer one.
"It's illegal to sell a damaged product at full price. If I bought a damaged cabbage from a greengrocer he'd have to sell it at the damaged price. The service Orange is providing me is damaged, as I signed up for fast broadband and merely receiving a 0.5mb connection. It's a damaged produce."
Either way they're going to lose.
They'll lose either on the grounds that they're failing to provide the service I'm paying for.
Or if they win that argument.
Then tehy'll lose on the grounds that the service they're providing is damaged and I'm being over-charged.
I'm very determined to force Orange to take me to court. They keep threatening to. I've had 2-3 letters from them now saying they're taking me to court.
As of yet, they haven't put their money with their mouth is. Because I've e-mailed them and told them exactly what I will say, and what exactly I will do.
I really don't understand why they don't just give in, provide me the service I pay for.. and I will then happily pay everything I owe, and happily pay the monthly fee.
It's the principle, see. I hate bullies. And Orange are exactly that, bullies, and someone needs to stand up to them in court.

I know it's probably a bit late but just for your information . . . . you will probably find that like BT and other ISPs, they do actually have a minimum level of service for your broadband speed.
I had a problem with BT last year and after a lot of hassle, I got 6 months service refunded as I was only getting 0.9mbps service and their contract stated I should expect a minimum of 1.5mbps. I had to threaten them and get nasty but they sorted it in the end!
Orange seem to have a standard business practice of threatening, intimating and harassing their customers and last month I took them to court and won a judgement against them under the Protection from Harassment Act.

Yes i'm still with Be and going good, its still totally unlimited and fast i havn't really had any problems with them, only one i had was when i changed to a static IP about 2 years ago and they changed it before emailing me the new IP, subnet and gateway lol but other than that alls ok.

Nah mate I'm still using my Netgear thingy with the flashed firmware on it. It may be just a minor routing issue as some sites work, and the odd one I visit often does need a reboot to fix it
