When i signed up to my new Orange contract (and hence got the free broadband package included) i phoned up to arrange my broadband and they told me they would be sending me a livebox
They said nothing about it being sent out on a "rental agreement" whereby i have to return the livebox to them when i leave Orange broadband
Anyway, when i received the livebox they said i need to sign 3 copies of the agreement and return 2 to them, which i havent done
Has anyone else not returned their agreement forms? Just want to make sure they wont disconnect me or anything!
I've never heard of any other broadband providers leasing modems to customers, its just stupid! And the fact that i wasnt told at signup time that it would be on a rental agreement surely infringed my consumer rights as had i known this i might not have decided to go ahead with the contract

I believe that the agreement is on Oranges note paper (not had one yet so going by what others have told me) yet the pre-paid envelope for agreement return is addressed to Net Lynk Ltd.
Now knowing how incompetent Orange are there is the posibility of :
1) A large pile of agreements sitting in Net Lynks warehouse, because Orange have not told them where to send them to.
2) A large pile of agreements sitting an Orange office and no one knows what to do with them.
3) Net Lynk have been trying to uploaded all the returned agreements to Oranges computers but can't because their exchange has been LLU'd
4) Or the favourite CSA phrase, our systems have crashed and we have lost all records of your fault, communication, previous calls and agreement return.
But you can bet it won't be Oranges fault, it will be the Post Office, Net Lynk, the cleaning lady, the gardner or whoever they can think of to blame.

I had a similar issue rgarding the Livebox rental.
I was out of contract and they offered a re-grade to the Broadband Max package for £17.99. The Livebox rental agreement said clearly that the rental was for a 12 month contact period.
After contacting Orange support, I was told that it was quite okay to sign it anyway as it was a generic form. I explained that by signing it, I was legally bound to a further 12 months with Orange and I was out of contract, but they just didn't get it.
In the end, I cancelled my Braodband Max package, but that's a different story and covered in a different posting.
Usually changing packages doesn't put you into a new contract, even with that form. There are a few occasions when it will but in those circumstances they should clearly tell you so and have to write it into the account notes.
when you return your livebox do you have to return your USB wireless adaptar as well?
Only if it was one of the Inventel adapters that was included in the older packs. If it's one you purchased extra or a Speedtouch adapter then it's yours.

It appears from the above that not having an agreement in with the livebox is not an isolated incident then !
Interesting questions arise.
1) if an agreement was not in the pack and obviously then not signed or returned, and,
2) no further communication, as in ALDO's case, or
3) no agreement in the pack, an email saying agreement not returned, phone call saying, " I aint had one " then still not one sent, as in my case.
Then no contract has been established!
No signature to the agreement.
No copy of the terms to the customer etc.
Could it then be construed as a gift or a non returnable item ???
Previous to the hire agreement there was no documents to sign and return and the contract still applied. Think of it more of a an agreement of understanding that the livebox is under hire rather than an actual contract in itself.
I called Orange yesterday to request a MAC code........but they requested I try the LiveBox...........ok says I like a daft sod........Email arrives this morning the agreement attached.
What utter crap can you beleive what Orange have done to a what was a very good service when run by Wanaddo.
It can stay in the box and I will not be signing any paperwork for a piece of equipment that is required to make their service WORK.........
What about having to return the livebox, if they sent it out to buy more time when they pretended it was my speedtouch modem causing my LLU upgrade problems.
Seeing as I signed no agreement, does that mean i can now throw it the bonfire on Nov 5th?
Just because you didn't get that agreement, as I said before previously it didn't come with one but still had to be sent back, doesn't mean it's yours. They'll still arrange collection or send a pouch for it if you cancel and if you don't send it back then charge you for it.
Thats why I said we think of it as an agreement of understanding rather than anything binding though if you want to be totally sure you'd need to get it legally checked out.
