Hey guys after being a long loyal customer from freeserve, wanadoo and now Orange I've only realised now that I am not getting the speed or service that I'm paying for. I went to my friends house who is with Sky broadband and his speed was amazing. I did a speed check and I have a speed capped to 2mb, even though my local exchange can give me up to 7mb and I am currently on an 8mb package. I want to change to o2 (now Sky) but when I called up they told me I had to pay the remainder of my contract which is £243 as i have a whole year left on my contract. Luckily I used the by law you have to give me a MAC code and in the end she said I will get it within 3 to 5 working days, but she did remind me I would still have to pay the cancellation fee. However for about a year my talk service has not been working the only thing they did to try to resolve it was that they sent me a new phone adaptor but that didnt work and so I couldnt be bothered after that as they said I would need to get a new livebox which i thought was just too long. Also now and again throughout the service Ive been gettin ppp server down during crucial times when Ive needed the internet to upload my coursework. When I go to the livebox settings it says Voip not in service, phone not available. But Im on a 8mb internet and talk package. When I get my MAC code I am giving it straight away to o2 (now Sky). But as for the cancellation fee do I have to pay for it, as I have one year left. I actually thought I was getting good broadband until I saw my speed against my friends and I remember watching watchdog about speeds not being correct. What should I do please help?

Quite simply you owe them the balance of your contract if you use the MAC.
Just because you've just realised you're not getting the speed you thought you were getting doesn't mean you can just up and leave without paying a penalty.

I was looking through the VOIP forum and I saw this
4.2 Broadband Unlimited comprises Three main elements. The first is the right to download files over the Internet in excess of the Usage Allowance applicable to Broadband Starter, the second is the provision of a higher connection speed (subject to any applicable technical restrictions) and the third is the Talk Service which enables you to make and receive phone calls over the Internet.
As I said above my talk service is not working and hasnt been for a while now. So wouldnt they have been in a breach of contract and therefore I shouldnt need to pay for the cancellation fee. I would like to report a problem and get it fixed but I already know what it is like to deal with Orange and quite simply I just want out and want to have a much better speed and service. They probably would send me a new phone adaptor again or just send me another livebox and in the end I would still have a rubbish service and a speed that I know can be improved. Well they're sending me the MAC code and then before I use it i'll cancel my direct debit and then I'll wait to hear from ISPA about what I need to do about the cancellation fee. Thanks for the reply anyways. After being such a loyal customer you would have thought they would offer you some sort of arrangement to improve the service if you are not satisfied, instead they just kept reminding me of the cancellation fee so that I wouldnt leave them. If only I stayed with the price plan I had before and did not end up signing myself up to an 18 month contract. AAArrrghh I hate small print and T&C's.

So you haven't even allowed Orange the opportunity to correct the problems.....so no, they aren't in breach but you are by leaving before the end of contract, that's why it's costing you £243 compensation.

Well I'm still gonna go through with it cos I'd rather have a better speed and better service and I'll let you all know how it goes. I probably have problems getting my MAC code. The only thing I will miss is the Orange wednesdays but I'll just get a PAYG chip.
