As probably one of the original users of Freeserve and subsequently Wanadoo as a dial-up member, I decided (much to my present dissapointment) to subscribe to the broadband service in November 2005. Shortly after, the Company was taken over by Orange (as the Internet Serviceless Provider).
After initially having problems paying my monthly fee via credit card (due to administrative problems - and/or incompetence on Wanadoo's/Orange's part), I now pay by direct debit. This fee is paid, without problems (but under protest) every month to Orange.
Now then, my problem, like so many others sharing this forum, is the poor quality of service (QoS) provided by Orange. Sometimes I cannot log onto the broadband service, sometimes I can (depending on what time of day or indeed DAY of the week it is), I have constant problems with email whereby I have to continually change the POP and SMTP server addresses and so on.
In the Terms & Conditions of the contract between myself & Orange it states that (succinctly) I pay them every month for a service in return. Therefore, they give me access to the Internet and email services in return for my money. The Company also trumpets in its literature and other sales material, what a great Company it is and how efficient, proficient Orange is.
So, as this is clearly NOT the case, am I within my rights to suspend payments to them as they (Orange) are not providing the service they are describing and therefore, are in breach of the contract between us??
Any comments - particularly those from a legal standing - will be greatly appreciated.

Its HERE you probably won't get much more info there than you do here.
Regarding your emails you would be better off opening a Gmail account and bypass Orange servers completely if you havn't already its a pain changing addresses but you won't ever have to change again and will be independant of any ISP you are with.

I've have a Hotmail account which I've been using to avoid specific servers. I've received my MAC today so hopefully won't have to tolerate any further unhelpulness from Orange much longer.
