My service still hasnt been upgraded 2 months after requesting it (still on 0.5mb)
I said I wasnt paying and that I would cancel my DD before they come for the money as they are in breach of contract for not delivering the service they promised they would.
My question is - Is it worth paying the cancellation fee and then taking them to court to get it back? OR Not paying in the first place and let them come after me with debt recovery teams etc. Which is the best option?

I have just emailed Orange myself over this same issue.
Last year I discovered that I was still being charged £17.99 for a service they were advertising at £14.99, because I was an old Wanadoo customer and that was their rate.
When I demanded that be reduced to the price they were advertising they claimed it was a different package and I would need to change packages to get that rate, to which I protest was not true and they were idntical in everyway, I realed off their own literature to them. When they finally changed the prices I was told nothing would change by their own staff as he admitted they were the same, I was never once told I was entering into a 12 month contract.
Long story short I have informed them that they are in breach of contract for failing to provide the service they have contractually agreed to provide, making it not fit for purpose and thus making the contract null and void.
If they do not provide that service it is they who have breached contract not the customer.
I will personally be demanding my MAC code and cancelling my DD if they fail to act, as well as rasing this with ofcom.

I have fallen for exactly the same trick. I have been paying £17.99 (for well over 12 months) for a £14.99 service. So I requested the change and they;ve now got me for another 12 months. The outgoing email service was never a problem until I reduced my fee, now I can only send emails intermittently. What a scam!

But....I was told that I was NOT in contract for changing from 17.99 (512k) to 14.99 (1/2mb) sue the b**tards
Complain to ISPA. Orange will ignore the first request from them for a response so you will need to go through the escalation process which is not hard. I got an apology and a refund from them - still not enough though.
