Get out now. Tell them they are not providing the service offered and therefore have not adhered to their terms of the "so called" contract, i did it they cannot expact ANYONE to pay for something they have not and CANNOT provide.

If they are refusing on grounds that you have to see out remainder of your contract then they are breaking the law.
The new process which is part of the Communications Act 2003 says that any recovering of money related to contactual obligations must be done separate from the recently introduced Migration Process when a customer requests a MAC.
Remind them of their obligatiions and if they will not provide one then ask for the matter to be escalated immediately in acordance with their own Code of Practice. If they refuse raise a complaint at www.isps.org.uk. You may also consider complaining to OFCOM but in this case I would do so by telephone.

this is correct, and it will be the broadband most likly, they have to give you a MAC code now, there was a little information about this on Watchdog on BBC1 at 7:00pm today, but you can always ask about it, unfortunatly, they have you on the speed issue, their contractual obligations to provide you with a speed of UP TO 8MB. although your speed is definatly under BB speed, but if it is over 1mb, there is not much you can do as you dont pay any more for 8 as you do for 1, and thats just the way that is. but in your case, id say that you have a point.

If you are getting less than this, then you should be able to state that they have not met their obligations and you should be able to get out.
