Are there any legal types out there who can offer some observations on the possibility of commencing a Class Action against Orange. Basis of claim might be the fraudulent obtaining of monies for services not provided.

I think that would be difficult and expensive. Basically if you are not receiving the services for which you have paid and it’s Oranges fault then write and tell them so. Tell them that you are cancelling due to a breach of contract on their behalf. Cancel your direct debit. When they take you to court for the balance of the contract as they will surely do, you then counterclaim for the period that you have paid them during which you have not received the service for which you have paid. I believe that the summons from the county court allows you to enter this counterclaim. People end up with CC judgements and bailiff visits because they are intimidated by bullying big business and do not turn up at court to defend themselves. If you can show the court that you haven’t received services for which you have paid and that the reason for this is that Orange has not met it’s contractual obligations then you will win the case. It’s as simple as that.
