I have a situation with wanadoo (who have since changed to Orange)
signed up for broadband, was told 10 days for set up, i was still waitin after a month so cancelled agreement. they accepted that, two days later a livebox arrived, which I still have sitting on my floor un opened.
I have now rung them 6 times on an 0870 number to get them to send me a "returns pouch" to get it back to them. every singel person i speak to including two "supervisors" have promised me they have ordered me one and it will be here in 3 days but nope, not a sausage, have checked my address with them etc.
so just wondered what i can legally do. can I charge them storage? or leave it outside my house for them to sort out?
I'm gettng nowhere
With regards to possession law, you basically have a limited selection of options. Option 1 is to write a letter instructing the owner that you have something belonging to them, give them a suitable time-frame to arrange collection (usually about 2-3 months) then inform them that you will be selling the item on, and will provide them with the money recouped from the sale, minus any administrative or storage charges incurred.
Option 2 is to take the livebox to the police as unclaimed or lost property. If they are unable to return the property to it's rightful owner, it usually reverts back to the person who handed it in. If you want the responsibility of dealing with their livebox out of your hands, this is probably the best option.
Incidentally, I believe that UK property law dictates that the property is not legally yours unless the rightful owner has failed to claim it within 6 years. Regardless of this, it is Orange's responsibility to reclaim the livebox, and not yours to return it at cost to yourself.
